What an awful, awful lady:

New York’s gay weddings victory lap has not extended to all parts of the Empire State, with a rural town clerk determined to not sign any same-sex marriage licenses.

Barbara MacEwen, the town clerk in upstate Volney who is responsible for signing marriage licenses in the town, said she’s morally opposed to same-sex weddings and does not intend to affix her signature to any marriage documents for gay or lesbian couples.

“If there’s any possible way to not do it, legally, then yes, I would not want to put my name on any of those certificates or papers,” MacEwen told POLITICO. “That’s their life, they can do it, but I don’t feel I should be forced into something that’s against my morals and my God.”

MacEwen said she’s written her state senator – Republican Patty Ritchie, who voted against legalizing gay weddings – to determine her legal options.

As John Cole wrote, she should quit. Simple as that. If her religion or morality is forcing her to violate the law and fail to do her job, then she should quit. Her morality is clearly more important than doing her job.

    I agree – if she feels that strongly about it morally, then she can quit and find something in line with her personal morals. I don’t necessarily despise people refusing to do what their conscience forbids them, but they should be prepared to take the consequences. And it’s possible that being without work for a while might change her politics as well…. I’ve known more than one Republican to go into shock when they realize how bad the safety net really is – after they apply for some needed help they thought they were entitled to and were turned down.

    There’s no reason to fire her or for her to quit. First, it probably won’t come up very often and when it does….just have someone else sign it. She is certainly not the only person in the township authorized to sign marriage certificates.

    A little tolerance and accommodation can go a long way.

      If the job requires her to apply the law as clerk, then she must do so. If she willfully refuses to do her job, then she should be fired. Is she doing the right thing according to her morals, yes. Is she doing the right thing ethically? No because she is not respecting the concept of Justice, Autonomy and Beneficence. Is she doing the wrong thing according to the law, yes. Therefore firing is justified and should be expected.

      Let’s try a thought experiment, shall we? If we lived in the 1950′s south and I was a city clerk. Let’s say in a state where miscegenation was illegal. If a mixed race adult couple came to me and asked for a marriage license and I refused to sign it because it was the law, would I be doing my job? Yes. Would I be acting morally? It depends on my personal moral standards. Would I be acting ethically? No, for same reasons above. Would I be acting legally? Yes. Should I be fired? No, I acted within the purview of my job requirements.

      She doesn’t have to quit but she should have to be fired IF she refuses to sign in an actual situation when a same-sex couple applies. Right now this is all hypothetical until she takes action one way or the other.

        But if nobody is harmed , then why fire her? If nobody in that town is ever denied their marriage license…where is the problem? Should she be fired for what she thinks?

          Her belief is unethical but only her actions can be illegal. Her belief is moral according to her cultural standards (not to ours obviously). So until she acts, she can’t be fired. I suppose calling for her to quit is the liberal way of avoiding the whole having to fire her issue. In fact, if they fire her before she acts…she may have good grounds for a wrongful termination lawsuit.

          PS: I still think what she believes is shitty. :)

        It’s not about whether or not she agrees or disagrees with the law. It’s about doing her job. If she refuses to do her job on the grounds of her “morality” then she needs to find a new job that’s more in line with her leanings. What she is intending is passive aggressive discrimination on the grounds of her morality and now that the law has passed that action would be illegal.

        And the “harm” in her actions is that she can start a trend for many other town clerks in the state who will refuse to issue marriage licenses to gay and lesbian couples on the grounds of their “morality”.

    I used to work for the state Department of Health. We had a guy there who was hired as a public health educator. Part of his responsibility was to conduct educational programs on STD prevention. He knew this was a requirement of the job when he was hired. He refused to conduct them because it conflicted with his religion.

    That was the one and only time I saw someone fired from a civil service position.

    If it’s part of her job and she refuses to do it, then she should accept the consequences.
