Assault Rifle Ban Upheld

Good news — the Court of Appeals in the fourth appellate district of California has upheld the state’s ban on assault rifles.

California’s law banning possession of a semi-automatic assault rifle is constitutional, according to a state appeals court that upheld the law Monday against a Second Amendment challenge. As the court’s opinion explains, the Supreme Court’s seminal Second Amendment opinion in District of Columbia v. Heller held that the right to bear arms is “‘not a right to keep and carry any weapon whatsoever in any manner whatsoever and for whatever purpose,’ but is instead the right to possess and carry weapons typically possessed by law-abiding citizens for lawful purposes such as hunting or self-defense.” Ownership of “[d]angerous and unusual weapons” is not protected by the Constitution.

Amazing things happen when you elect a Democratic administration and a Democratic super majority in the legislature.

They do things like break decades-long stalemates over taxes, expand access to abortion, and ban assault rifles.

      Hey I live in northern California and we are almost as blue as you can be, there are a number of democratic counties are in northern California – the SF bay area is home to a lot of liberals! You must be thinking of the far northeastern section of the state…………….

    I am from California. It is amazing what has happened there since they said Asta la vista to Arnold and the gaggle of republicans who ran the state into a 31 million dollar deficit.

      Indeed !! we still have a long way to go – the damage done by Reagan , the Duke, Wilson and as a result of Cheney’s energy embargo to the western blue states in 2002 Arnie too was vast and deep -

    I’m pleased by this decision (makes me proud to be a Californian), but the endless appeals will bring the case before the same US Supreme Court which invented an individual right to bear arms.

    This could end very badly.

      I am sooo glad to live in California It just keeps getting better every year – sure did take a long time to start fixing what Reagan, the Duke, Wilson and the guvernator did to it – just goes to show what TOTAL democratic control can do for progress !! I do hope you are wrong about the end of this play, yet fear you are right – the Supreme 5 are a dangerous group of jaggoffs….

      Well, let’s let someone argue before the Supreme Court that people have a right to keep and bear, oh say, a small tactical nuclear bomb and see just how quickly the Court (even the nuttiest of the “original intent” nuts*) finds a way of squelching *that* particular interpretation.

      *If I’m remembering correctly, wasn’t it the “original intent” branch that altered the 2nd Amendment’s *actual* wording to “discover” the “individual” right?
